Our terms and conditions
comply with current legislation and are designed to ensure
that our customers can shop easily and with confidence. We
reserve the right to change these terms at any time.
2.
PRICING & ORDER & SHIPMENT PROCESS
All prices are
clearly displayed on the web site and will be confirmed at
the checkout prior to payment. You may pay by any major
credit or debit card that is listed on our website. We are
under no obligation to accept your order. Prices, offers and
products are subject to availability and may change before
we accept your order. We will not be deemed to have accepted
your order until your order is delivered to you. The
shipment options available will be clearly displayed in the
checkout process. The cost of shipment (if any) is shown
clearly on the web site at the checkout. We will only
deliver your goods to the registered address of the card.
Once your order has been accepted we cannot change the
shipment method.
3.
ACCEPTING ORDERS & SECURITY
When you place an order we
will treat it as an offer to buy. We will send you an email
to confirm receipt of your order. However, we will be
entitled to refuse to accept your order if we feel it
necessary, in which case we will email you as soon as we can
to let you know. When you order you will have an opportunity
to check the details and correct any input errors. If we
decline your offer on security grounds we may contact you to
seek an alternative payment method.
4.
RETURN OF GOODS
We want you
to be completely satisfied, so Embedded Automation offers a
30 day money back guarantee on your purchase.
Return of goods must be pre-authorized by Embedded
Automation. Upon approval, Embedded Automation will
issue a Return Materials Authorization (RMA) number. Returns
without an RMA number will not be accepted and will be
returned at your expense. For additional information, please
refer to Embedded Automation RMA documentation.
New unopened merchandise returned within 30 days will
receive a full refund less our shipping costs. Merchandise
that has been opened but can be sold as new will be assessed
a 20% restocking charge. Merchandise that has been
installed, marred, altered, or damaged cannot be returned.
Our money back guarantee does not include freight charges to
or from our office. We will deduct the actual freight cost
incurred to ship your order, from your return. Special
orders, software, batteries, and books are not eligible for
exchange, credit or refund.
We will not be responsible to the loss or damage of returned
item(s) by couriers, so we suggest that you insure your
shipments and ensure they can be traced with a delivery
signature for your protection.
Warranty returns also
must follow our RMA guidelines. If upon our analysis, the
product complies to the
documented specifications, we will return the product to
you. However, if the returned product fails to comply with
documented specifications, the defective product will
be repaired or replaced with a similar model or in some
cases we may refer your case to the manufacturer for support
at our discretion. Some manufacturers may require the end
user to deal with them directly for warranty support, and we
will honor their procedures where applicable.
Any 'Free Gifts' received with the product must also be
returned. Please also refer to the product’s Warranty
documentation.
This return policy does not cover
faults caused by accident, neglect, misuse or normal wear
and tear; servicing not authorized by Embedded Automation;
usage that is not in accordance with product instructions;
failure to follow the product instructions or failure to
perform preventative maintenance; or problems caused by
using accessories, parts or components not authorized by
Embedded Automation.
5.
SOFTWARE
All software is
licensed to you with the terms and conditions of the
applicable license agreements. These license agreements are
shipped with the software.
You are responsible for
ensuring that any software ordered by you is suitable for
you requirements and is compatible with your existing
systems. We consider sending license keys to be opening the
software package, therefore once keys are emailed to you as
part of a purchase,
all sales are final – we cannot accept returns.
Warranty information is provided as part of the End-User
License Agreement.
6.
ORDER CANCELATIONS
For any order cancellations: you must
contact
store@embeddedautomation.com
within 24 hours of when the order was placed. Orders not
cancelled within the 24 hour grace period are subject to a
25% administrative and restocking fee.
Order
cancelations apply only to physical items. Software items
are bound by the above Software paragraph.
7.
WEB SITE TERMS OF USE
We recognize the copyright and
trademarks in all materials on this site, which may not be
used, downloaded, copied, reproduced, republished, posted,
broadcast, transmitted or linked without written consent
from Embedded Automation. You agree not to adapt, alter or
create any derivative work from any material on this site,
or to restrict or inhibit the use or enjoyment of this site
by anyone else.
8.
VOUCHER CODES
One voucher code is valid per transaction.
All voucher codes issued are for single items and will not
relate to multiple products. Vouchers codes are not
redeemable indefinitely; an expiry date will always be shown
where the voucher code is advertised. In the event that an
advertised voucher code does not work while within the
advertised promotion running time, please email us
at
store@embeddedautomation.com.
9.
GOVERNING LAW ETC
Sales on this web site are governed by
Canadian law and you agree to submit any dispute to the
non-exclusive jurisdiction of the British Columbian courts
in Canada. All orders are subject to these terms and
conditions, and no amendments will be accepted by us.
10.
LINKS TO OTHER SITES
These
terms and conditions only cover this web site. Any other web
sites to which you link from this site are governed by their
own terms and conditions. We accept no responsibility or
liability for the content of web sites that are not under
our control.
11.
LIMITS ON LIABILITY
Except where prevented by law from
restricting or excluding liability by law, in no case will
any liability that we might incur whether in contract, tort,
or otherwise to you exceed the total amount of paid by you
for the products that you have purchased from us relating to
any claim that you make. In no circumstances shall we be
liable for any consequential loss (including any loss of
revenue or profit). If you wish to increase or remove these
limits on our liability, please contact us. We may be
prepared to agree to increase or remove them, but this may
be on the basis that the prices that you pay for products
are increased. Nothing in these terms and conditions affect
your legal rights.
